Funda

Terms of Service

Teacher registration pilot and assessment drafts. Where these features are enabled, teachers must use an adult account and provide their own ID and an authentic confirmation letter for the school association they request. Do not impersonate another person or school, upload a child’s ID, or upload material you are not authorised to provide. Supported file types and upload limits appear in the registration form.

The pilot message “Registration Successful with Document Review Pending” confirms receipt of the two documents. It does not confirm an AI authenticity check, professional accreditation, employment, school approval or school verification. Completing pilot registration does grant access to learner usernames, grades and learning progress at the selected active school while review is pending. It does not grant family administration rights or access to learners at another school. Use this access only for your authorised educational work. Class assignments and parent class selection are planned for later. The pilot uses an automatic pending-review outcome and does not send these registration documents to an AI provider. Registration may require further review before additional features are granted. Do not rely on the pending status as a verified credential.

Assessment drafts are private preparation material. Saving a draft does not publish or assign it. Where assessment delivery is enabled, the organiser must review the fixed paper and select only learners within their family, school or approved-group authority. Opening times, cutoffs and attempt timers are enforced by the server; refreshing or changing a device clock does not restart an attempt. Upload permitted work before submission/cutoff. Submission locks answers; expiry can submit already saved work. Network failure can prevent unsaved work or an incomplete upload from arriving on time. Organisers may make explicit, recorded extensions or reschedules; an extension is not automatic.

Paid AI marking is disabled in this pilot. Submitted work awaits marking without a placeholder score. A future enabled AI result must be labelled and reviewed where uncertain; it is educational feedback, not a guaranteed or official examination grade. Organisers control feedback release, and learners may request review. Approved-group event requests require an adult organiser’s decision and paper/participant selection. Do not disclose answers or other learners’ submissions during an ongoing assessment.

These terms govern the Funda learning web application operated by Sunnergy (Pty) Ltd. They describe the service, acceptable use and the responsibilities of adults managing learner profiles. They should be read with the Privacy Policy.

1. Operator and contact

2. Acceptance and who may manage an account

An adult with legal capacity must manage a parent/guardian account. By selecting the terms-agreement checkbox when creating an account, you accept these terms. If you act for another person or organisation, you must have appropriate authority. Learners use their permitted learning features under the authority of the person managing the profile; children are not asked to enter an independent adult contract.

Do not create or manage a child’s profile without being their parent/guardian or another person legally competent to authorise the processing. Obtain permission before managing another adult learner. The learner’s access code is not permission to take over the parent account. Existing users will be given notice of applicable changes; this wording does not fabricate a record that an existing user previously accepted these terms.

Guest practice does not require an account. Children should use it with the knowledge and appropriate supervision of a responsible adult. The privacy notice explains that technical requests and temporary preview sessions can still be processed.

3. What Funda provides

Funda provides subject/topic practice, quizzes and, where available, saved progress, scores, practice points, school aggregates and approved social learning features. Content availability varies by grade, subject, topic and language pathway. Some banks are limited or still being developed.

Funda is supplementary practice. Question counts, CAPS references, points or a high quiz score do not establish full syllabus coverage, independent mastery, an accredited qualification, admission eligibility or a guaranteed examination result. Some questions use generated parameter variants or provisional content that still requires editorial review. Multiple-choice practice cannot replace practical, oral, drawing or extended-writing assessment.

Use teachers, official materials and appropriate professional guidance alongside the service. Educational health, science, legal or financial examples are not personalised professional advice. Curriculum names identify the intended content scope; Funda does not claim endorsement by a school, examination body or the Department of Basic Education unless expressly stated.

4. Account and learner safety

Provide accurate account information and a school/grade appropriate to the learner. Choose privacy-safe usernames and group names. Keep passwords, sign-in links and access/invitation codes confidential. You are responsible for taking reasonable care of access you control and promptly reporting suspected misuse; this does not make you automatically liable for an event outside your reasonable control.

Share a parent invitation only with an adult who should have access. Review connections and group membership before approving them. Approved members may see usernames and group points as described in the privacy notice. Do not use these features to identify, contact, harass or profile children outside the intended learning features. There is no private student-messaging feature in this release.

5. Acceptable use

Use Funda lawfully and respectfully. Do not:

Authorised security testing requires separate permission. If you discover a vulnerability accidentally, stop accessing affected information and report the issue privately to support without disclosing learner records publicly.

6. Content and intellectual property

You receive permission to use Funda’s available learning features for their intended educational purpose while complying with these terms. Intellectual-property rights remain with their lawful owners to the extent those rights exist. This does not override a third-party or open licence, public-domain status, or rights granted by law.

Third-party artwork and software may carry separate licences. The deployed avatar assets include Twemoji artwork under CC BY 4.0, with attribution and licence information in the assets folder. You retain applicable rights in information you provide; supplying it is not a transfer of ownership. We process it as explained in the privacy policy, not under an unrestricted right to reuse children’s information.

7. Scores, saved work and availability

Actual quiz correctness and cumulative practice points measure different things. Rankings, when offered, are practice features, not official school results. Save/resume depends on supported sessions and service availability. Guest answers can be lost when you refresh, leave or close the page, and guest results are not saved to account history.

We may correct errors, maintain systems or change available features. We aim to give reasonable notice of material changes where practicable. Availability is not guaranteed, and a feature described as planned or coming soon is not a promise of a delivery date. Where an error materially affects a result, contact support so it can be investigated.

8. Charges and third-party services

These terms do not authorise automatic charges or create a paid subscription. Any future paid offering must disclose its price, billing and cancellation conditions before purchase and obtain any required agreement. Your own internet/data charges may apply.

Hosting, authentication, email delivery, optional Google sign-in and other external services may be subject to their providers’ terms. Funda’s use of a provider does not remove Sunnergy’s own responsibilities. We do not need your Google password, Gmail messages or Drive files for ordinary Google sign-in.

9. Suspension, closure and privacy requests

We may restrict access where reasonably needed to protect learners, prevent misuse, comply with law or maintain security. Where appropriate, we will explain the reason and offer a way to raise a concern; urgent protective action may occur first. Restrictions must remain consistent with applicable consumer and privacy rights.

You may stop using the service and contact support to request account or learner-profile closure, correction or deletion. We will verify authority and consider relevant records, other authorised users and lawful retention needs. Signing out or uninstalling a browser does not itself delete server records. Handling retained information is governed by the privacy policy and applicable law.

10. Service limitations and legal protections

We take reasonable care but cannot promise that every question, answer key or service function is error-free or suitable for every learner. Report suspected errors rather than relying on a practice result as the sole basis for an important decision.

To the extent permitted by law, Sunnergy is not responsible for indirect or consequential loss arising solely from ordinary interruptions or reliance on supplementary practice. Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable protections relating to fraud, wilful misconduct or gross negligence. No clause removes mandatory rights under South African consumer, privacy or other applicable law, and no blanket indemnity is imposed on a child or family.

11. Changes, disputes and applicable law

We will date/version material changes and provide notice or request renewed agreement where required. Changes do not retrospectively remove accrued rights. If a provision is unenforceable, the remainder applies only so far as lawful and workable.

South African law governs these terms, subject to any mandatory protections that apply to you. Contact support to try to resolve a concern. This does not prevent you from contacting a regulator, tribunal or court with jurisdiction, impose compulsory private arbitration, or require you to give up a statutory remedy.
